1. Program Description
The i.seeKissimmee program is a guest blogging program sponsored by the Kissimmee Convention & Visitors Bureau. Selected visitors to Kissimmee will be invited to blog, through text, photos, and video, about their experience visiting the Kissimmee destination. Blog entries will be posted on one of the CVB’s websites. Selected guest bloggers are encouraged to cross-post content to their personal blogs, on message boards, or share on other social networking sites.
2. Timing
The program began November 1, 2009 and will run on a continuous basis until terminated by the CVB. Changes to the program may occur at any time, and without prior notification. Up to four bloggers will be selected for each calendar month. Selected guest bloggers will be assigned to a mutually agreeable time period for participation.
3. Eligibility
Eligibility for this program is open to all individuals age 21 or older. There are no residency restrictions, however non-US residents must possess valid travel documents, including a passport and visa if required. Employees of the Kissimmee Convention & Visitors Bureau, Osceola County, the CVB’s industry partners, and their families are not eligible to participate. Guest bloggers must be able to communicate effectively in English. Guest bloggers must stay in Osceola County during their visit, unless a resident of Central Florida (defined as Osceola, Orange, Lake, Polk, Seminole, Brevard, and Volusia Counties).
4. Application
Complete the online application form at i.seeKissimmee.com, which includes a section to describe your planned itinerary and travel party. You must also include a writing sample or links to other social media content that you have created. Applications will be accepted on a continuous basis beginning November 1, 2009. Once you apply, your application will remain active for a period of six months.
5. Selection Process
Selection of the guest bloggers for the program will be made by a committee of CVB employees. Decisions of the committee are final and cannot be appealed. The committee will judge applications on the following qualities:
- Communication ability based on samples of content provided
- Creativity
- Variety of experiences within the Kissimmee destination
- Ability to travel during available time periods
Selected guest bloggers will be notified on a rolling basis. Selected guest bloggers will have the option to either accept the offered assignment or ask to be considered for a different time period. Applications will remain active for six months, after which time, prospective bloggers will need to submit a new application.
6. Program RequirementsDuring the assignment, CVB guest bloggers must provide a minimum of 11 blog entries:
- An introductory/bio entry introducing themselves and their travel companions
- A minimum of one pre-trip/trip planning entry
- A minimum of one entry per day during the trip
- A minimum of one entry on your Osceola County accommodations (applies to non-local residents only, unless local residents choose to stay in Osceola County lodging)
- A minimum of one post-trip entry
Trips may be of any duration up, but guest bloggers must still post the minimum number of entries in addition to the introductory/bio entry. All entries should include photos and/or video.
The selected guest blogger will be provided access to the blogging entry section of the CVB’s website.
The CVB retains the right to review all blog content before it goes live, but will not edit the blog entry except in the event of offensive content (sexually explicit, obscene, pornographic, violent, discriminatory, illegal, offensive, threatening, profane, or harassing; as defined in the sole discretion of the CVB).
The blog will be open for user comments, and any industry partners mentioned in the blog entry will be permitted to post a comment, governed by the same restrictions against offensive content.
The guest blogger is encouraged to cross post blog content to a personal blog or other social media outlets, including, but not limited to Facebook, YouTube, Flickr, message boards, etc.
The guest blogger is responsible for compliance with all FTC rules and guides regarding disclosure of incentives when posting to other blogs and networks.
7. Incentives
Guest bloggers participating in the i.seeKissimmee program will be entitled to receive a per diem stipend of $100 per day for each day that they are in the Kissimmee destination, up to a maximum of $700. The CVB will work with industry partners to arrange for discounts and/or complimentary admissions, lodging, and meals. All discounts and offers for complimentary products and services will be included in the notification of selection. All other expenses are the sole responsibility of the guest blogger and their traveling party. The program is not intended to offer a free vacation experience.
8. Content Ownership and Licensing
The guest blogger maintains ownership of the content, but grants to the Kissimmee CVB and its industry partners a perpetual license for use of any and all blog content, including text, photos and videos. The guest blogger warrants that they have permission to use any images, photos, videos, and another media included in all blog entries submitted as part of this program.
9. Other Terms and Conditions
a. Liability: The Kissimmee Convention & Visitors Bureau, and Osceola County, and its employees will not be held liable for any action of the guest blogger while working on this assignment. Further, the Kissimmee Convention & Visitors Bureau, Osceola County, and its employees will not be liable for an injury suffered by the result of the guest blogger while traveling in the area for the purposes of completing this blogging assignment.
b. Governing Law: The laws of the State of Florida shall govern all aspects of this Agreement. In the event it is necessary for either party to initiate legal action regarding this Agreement, venue shall lie in Osceola County, Florida. The parties hereby waive their right to trial by jury in any action, proceeding or claim, arising out of this Agreement, which may be brought by either of the parties hereto.
c. Public Records: The guest blogger understands that by virtue of participation in this program, all of its documents, records and materials of any kind, relating to the relationship created hereby, shall be open to the public for inspection in accordance with Florida law.
d. Independent Contractor: The guest blogger acknowledges that participation in this program does not create an employee/employer relationship between the parties. It is the parties’ intention that the guest blogger, its employees, sub-contractors, representatives, volunteers, and the like, will be an independent contractor and not an employee of the Convention & visitors Bureau or Osceola county for all purposes, including, but not limited to, the application of the following, as amended: the Fair Labor Standards Act minimum wage and overtime payments, the Federal Insurance Contribution Act, the Social Security Act, the Federal Unemployment Tax Act, the provisions of the Internal Revenue Code, the State of Florida revenue and taxation laws, the State of Florida workers’ compensation laws, the State of Florida unemployment insurance laws, and the Florida Retirement System benefits. The guest blogger will retain sole and absolute discretion in the judgment of the manner and means of carrying out the blogging activities and responsibilities.
The guest blogger, at its sole expense, shall obtain all required federal, state, and local licenses, including passports and visas, if needed, required to successfully participate in the guest blogger program. The blogger is further responsible for all costs associated with participation, including, but not limited to: travel costs, photography, videography, computer access, etc.
e. Compliance with All Laws: The guest blogger, at its sole expense, shall comply with all laws, ordinances, judicial decisions, orders, and regulations of federal, state, county, and municipal governments, as well as their respective departments, commissions, boards, and officers, which are in effect at the time of participation in this program.
f. Indemnification: The guest blogger agrees to be liable for any and all damages, losses, and expenses incurred, by the COUNTY, caused by the acts and/or omissions of the guest blogger, or any of its travel companions, employees, agents, sub-contractors, representatives, volunteers, or the like. The guest blogger agrees to indemnify, defend and hold the COUNTY harmless for any and all claims, suits, judgments or damages, losses and expenses, including but not limited to, court costs, expert witnesses, consultation services and attorney’s fees, arising from any and all acts and/or omissions of the guest blogger, or any of its travel companions, employees, agents, sub-contractors, representatives, volunteers, or the like.
